“They Are So Out-Of-Whack Liberal, They Are The Most Overturned Court In The Country”

Press-Trumpeted Lies About The 9th Circuit Court Of Appeals, And The Bush Republican Plan To Take Redistricting To The Courts As Well

SEPTEMBER 16, 2003 - Let’s get the facts straight up front.  The 9th Circuit Court of Appeals - for the most recent year for which we have records, 2002 – was overturned far less often than 4th, 5th, 8th, and 10th Circuit Federal Appellate Courts.

Wait a second now, we hear nothing on the radio and TV but that the 9th Circuit Court of Appeals, located, of course, in Bush-hated California, is so ridiculously liberal, unprofessionally biased and skewed, that it is the most overturned court in the country, or as California Gubernatorial candidate Tom McClintock said a few days ago, “a ridiculous court.”

This is another one of those lies that starts from talk radio and FOX News and gets repeated so frequently and adamantly by them and by the legions of Bush-brand goons that go onto the “mainstream” media talk shows that it, over time, becomes reported as if it is not only true, but an uncontested fact.

The reason for this assault on the 9th Circuit is obvious – as with their redistrictings and recalls and recounts, the new breed of Bush/Limbaugh Republican wants to be able to bully everyone and everything into being nothing but a right-wing puppet.

The 9th Circuit Court of Appeals was overturned 75% percent of the time in 2002.  The 4th, 5th, 8th, and 10th Circuit Courts were overturned 100% of the time.

Um, guys, you all have been doing something called LYING.  In no way is the 9th Circuit Court of Appeals the most overturned court in the country.

Now if these percentages seem high to you, they are – this is because the Supreme Court only agrees to hear or review cases that it might overturn.  Cases it agrees with it simply refuses to hear.

So, don’t take the above numbers to mean that the 4th, 5th, 8th, and 10th Circuit Courts are incompetent or so unprofessional and biased that they were overturned every single time the Supreme Court reviewed one of their cases.  To do so would make you a dishonest, manipulative scumbag like the Bush-brand idiots who try to say having a high percentage of cases overturned means the 9th Circuit Court is out-of-whack liberal.

The appeals court in Virginia , the 4th Circuit Court of Appeals, is an extremely conservative court.  It has been called, “A court that always veers to the right.”  (see New York Times article)  It was overturned 100 percent of the time.  So I suppose we should begin by fixing that court, right?

Nope, the Republicans, not satisfied with just stealing congressional seats through redistrictings and Governorships through recalls, want to now attack and destroy any court that doesn’t veer to the right as well.  The bullying that Peter Jennings (see ABC's Peter Jennings Admits ABC Has Been Bullied To The Right By The Bushies) and Christiane Amanpour (see CNN's Christiane Amanpour Joins The Chorus Of Top 'Mainstrem' Media People Saying They've Been Bullied To The Right By The Bushies) say is being used even on the top reporters of the largest stations is now being aimed at the 9th Circuit.  This new breed of Bush Republican will not rest until they have taunted, attacked, and bullied every single American institution into being nothing but Bush Republican puppets.  And so they are now reportedly looking at redistricting the 9th Circuit, breaking up the district - using the fictional excuse of their own creation, that it is “The most overturned court in America” – so that they can change its makeup to be more to their liking.

So the question remains what sort of America-hating, ballless pansies listen to and watch lying distorters whose ultimate goal is to repeat the same lies over and over until they have you one of their pathetic mass of disinformed drones, marching as a part of their all-out assault on America and American values?  What sort of weak-minded cowards cling to FOX News and AM Radio?

This is not a Republican thing or Democrat thing or liberal vs. conservative thing.  A good Texas Republican once warned us about exactly what is happening.  President Eisenhower told us that we had better, “beware the military industrial complex.”  Current Republican Senator John McCain points out from time to time that the Bush/Cheney administration and its actions are exactly what Eisenhower had warned about (see "President Eisenhower Must Be Speaking Out In His Grave About The Military Industrial Complex That He Warned About")  Eisenhower had said that its influence was being felt in every office of the federal government and every corner of the nation.  This good conservative General and President warned us that we, “must guard against,” these people gaining “undue influence.”

Well, they have it.  And they will not rest until they have turned America into the Soviet Union of old.  The situation now is not conservative against liberal, Republican against Democrat, but good, moral Americans against self-promoting Bush-brand Machiavellians who despise everything about America and seek to turn us into the former Soviet Union.

Aside from being pathetic, this is entirely stupid, and demonstrates the reason why President Bush’s foreign policy is such a failure – and why he doesn’t realize how bad it is or have any willingness or ability to change it for the better.

It is the Star Wars battle, the light side vs. the dark side.  To the Bushies, power is and success comes through the use of hatred and belligerent, bullying force.  Victory will come by intimidating and battering people into obeying your will.  Yes, exactly the idea the Soviet Union had that led it to be defeated by…. no one – it was so fully flawed it just collapsed onto itself.

Having strong surveillance of all of the nation’s citizens, invading countries they wanted to control, bullying and intimidating anyone within the country who didn’t support the Party-line were what made the Soviet Union so weak it buckled at the knees.

America won the cold war because of a power much stronger than atomic bombs – the power of American values.  Freedom, democracy, the cultural appeal of Hollywood films and American music, and, of course, a good supply of toilet paper won the will of the people worldwide – and this will knocked down the Berlin Wall, brought down the Soviet Union from within, and since has carried people like Milosevic off to prison.  This is the power you can not just feel, but see and hear no matter where you go on the planet – be it the mountains of Brazil, the plains of Poland, or an island in the South Pacific:  American music, American TV shows, and a desire on the part of the people there to be more like Americans, and, in fact, to become American some day.

No amount of nukes could give the Soviets this power.  No number of smart bombs can give it to us.  All the nukes on the planet couldn’t have saved the Soviets.  And no number of nukes will be able to save us if we take the Bush approach of fighting and running the country the Soviet way.

The 9th Circuit Court of Appeals leans to the left.  The 4th Circuit Court of Appeals leans to the right.  That is how the American system works.

Those of you who choose to join the dishonest, Soviet-like chorus of 9th Circuit Court attackers, I have just one question for you:  if you hate America and American values so much, why don’t you just leave?  There are lots of undemocratic dictatorships, in South America, Africa, Asia, that have just the setup you are trying to install in America.  We know you are upset that your favorite side lost the Cold War, but the Soviet Union is not coming back. Period.  Not on The Moderate Independent’s watch.  So you have two options:  go to someplace that hates America like you, or join the rest of us good Americans who believe in and stand up for truth, freedom, and democracy.
